Vacation Home Help – Terms & Conditions

These Terms & Conditions (“Agreement”) govern all services provided by Flamingo International Inc. DBA Vacation Home Help (“Vacation Home Help,” “we,” “us,” or “our”) to the property owner (“Owner,” “Client,” or “you”). By enrolling in any services, Owner acknowledges they have read, understood, and agree to be bound by this Agreement.
Terms

1. Scope of Services

Vacation Home Help provides cleaning services, maintenance coordination, co-hosting/management support, revenue management, licensing assistance, tourist tax administration assistance, and referrals to independent contractors (“Vendors”). Specific services depend on the plan or package selected by the Owner.
Owner acknowledges that some services are performed directly by Vacation Home Help, while others are performed by independent third-party Vendors.

2. Acceptance of Contract & Referral Agent Role

VACATION HOME HELP accepts this Agreement and agrees to furnish its services as a referral agent, referring qualified Vendors to perform cleaning, maintenance, and other property services as requested by Owner.
Vacation Home Help will exercise due care in selecting Vendors and monitoring services. Each Vendor is independently owned and responsible for their own taxes, insurance, and liabilities.

3. Care, Responsibility & Guest-Related Damages

Vacation Home Help shall exercise due care in the performance of its services and is responsible for loss, damage, or negligence caused directly by its employees, contractors, or representatives.
Guest-Related Damages
If guest-caused damage occurs:
Owner acknowledges that Vacation Home Help is not the insurer and cannot guarantee claim approval or payout.

4. Term Commitment & Early Cancellation

Plans requiring a minimum term are subject to a $750 early termination fee if Owner cancels before the term ends.

5. Billing, Payment & VOID Check Requirements

Owner agrees to provide a VOID check for billing and automatic payment setup.
Invoices & Payments
Disputes
Owner may dispute charges within 15 days of receiving an invoice. Both parties agree to resolve disputes in good faith.
Billing Changes
No change to billing method is effective unless confirmed in writing by both parties.

6. Communication Requirements

Owner agrees to communicate primarily through email, the preferred method.
All service requests must be sent to: info@vacationhomehelp.com Phone communication will be documented via follow-up email.

7. Trips to Property, Additional Fees & After-Hours Rates

Included Trips
Each guest reservation includes:
After-Hours Rates (require Owner approval)
Additional Trips (Owner approval required)
During business hours:
After-hours or holidays:
Pool Heat Adjustments
If Owner uses an included trip for pool heat activation or deactivation, it counts toward the included trip quota.
All additional trips require express Owner authorization.

8. Licensing, Permits & Tourist Taxes

Vacation Home Help assists with:

Vacation Home Help’s role is administrative only and not tax advisory.

9. Termination of Agreement

Either Party may terminate this Agreement with written notice.
Termination must be emailed. Vacation Home Help will confirm receipt within 2 business days. If no confirmation is issued, termination is automatically processed.
Early termination fees apply where stated.

10. Independent Contractors & 1099 Reporting

Vacation Home Help arranges services as an Agent, referring independently owned and operated Vendors.
Each Vendor is responsible for their own insurance and taxes.
Vacation Home Help will file appropriate 1099s for qualifying Vendors.

11. Disclaimer (No Legal, Accounting, or Tax Advice)

Vacation Home Help does not provide legal, financial, tax, or accounting advice.
Any help with licensing, taxes, or filings is administrative support only. Owner should consult a licensed attorney or CPA for professional guidance.

12. Mutual Indemnification

Each Party agrees to defend, indemnify, and hold the other harmless from claims, damages, or costs (including attorneys’ fees) arising from their own acts, omissions, or negligence.

13. Price Adjustments & Competitive Pricing Protection

Fees remain fixed during Owner’s initial term.
After term expiration:
If Owner finds equivalent services at a lower market price, Owner may:
Vacation Home Help will cooperate in good faith.

14. Non-Solicitation & Poaching of Vendors

Owner agrees not to hire, solicit, or contract any cleaner, maintenance technician, contractor, or personnel introduced or referred by Vacation Home Help without written permission.
If Owner directly hires any referred Vendor:
This protects the integrity of our contractor network.

15. Hold Harmless Agreement

Owner agrees to hold Vacation Home Help harmless from any and all claims, damages, losses, or,
Liabilities arising from:
Vacation Home Help remains responsible only for damages caused directly by its own employees or contractors, as stated in Section 3.

16. SMS Terms & Conditions

SMS Consent & Privacy
Owner’s phone number will never be shared with third parties for marketing.

17. Governing Law

This Agreement is governed by the laws of the State of Florida, without regard to conflict-of-law principles.
